AITANIA Terms of Service

1. Acceptance and Scope

Welcome to AITANIA. These Terms of Service ("Terms") form a legal agreement between you and Mindzen AI Studio and apply to your access to, download of, installation of, registration for, browsing of, or use of AITANIA and related services.

By using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and related policies. If you do not agree, do not use the Service.

To the extent permitted by applicable law, these Terms include arbitration and class action waiver provisions. Certain disputes may need to be resolved through binding individual arbitration rather than court litigation or class proceedings.

2. Description of the Service

AITANIA is an AI-driven single-player interactive RPG and story adventure service. The current version may include:

• Guest play, account registration, sign-in, sign-out, account management, and account deletion.
• AI-generated adventure chat, turn-based story progression, portals, party state, routes, and gameplay choices.
• Character Archive, Character Stories, and Character Chat.
• Local saves, cloud saves, account progress, story progress, tutorial progress, and character chat synchronization.
• Aether, daily Aether, permanent Aether, AITANIA PASS, in-app purchase flows, purchase restoration, and entitlement verification.
• Links to legal pages, account deletion pages, community resources, app stores, and other third-party services.

We may add, modify, suspend, limit, or discontinue features from time to time.

3. Eligibility

You represent and warrant that:

• You are at least 18 years old.
• If the laws of your location require a higher minimum age, that higher age requirement applies.
• You have the legal capacity to enter into and comply with these Terms.
• Your use of the Service is not prohibited by applicable law.

If you do not meet these requirements, do not use AITANIA.

4. Accounts, Guest Access, and Security

4.1 Registration and Sign-In

AITANIA may allow guest access and may also allow you to create an account using a username and password. You must provide accurate, complete, and non-misleading information and keep your credentials secure.

Guest access is intended for temporary or lightweight play. Guest identifiers, guest saves, or guest progress may be lost if local storage is cleared, the app is uninstalled, the guest session expires, or the Service changes. Purchases and long-term entitlements require a signed-in non-guest account unless the app expressly states otherwise.

4.2 Account Responsibility

You are responsible for activity that occurs through your account. You may not:

• Share an account with another person.
• Lend, rent, sell, transfer, or commercially exploit an account.
• Acquire, purchase, or use an account through unauthorized means.
• Register under a false identity or impersonate another person.
• Use automated or abusive methods to register, log in, or create accounts.

If you believe your account has been compromised, contact us promptly.

4.3 Registration Limits and Abuse Prevention

We may limit registrations, login attempts, analytics requests, chat requests, purchases, saves, or other activity to protect the Service. We may use technical measures such as session controls, rate limits, IP-derived keys, install IDs, hashed identifiers, purchase verification, and abuse detection.

5. AI Output and Risk Disclosures

AITANIA relies on AI-generated content. You understand and agree that:

• AI output may be inaccurate, incomplete, repetitive, distorted, outdated, unsafe, offensive, or otherwise not meet your expectations.
• Story content, character dialogue, suggestions, explanations, and choices are provided for entertainment and interactive gameplay only.
• The Service is not medical, psychological, legal, financial, tax, emergency, safety-critical, or other professional advice.
• You are solely responsible for evaluating AI output and must not rely on it for real-world decisions, diagnosis, treatment, emergency action, legal conclusions, or financial decisions.
• If you are experiencing a real-world medical, mental health, self-harm, safety, or other emergency, contact local emergency services or an appropriate professional immediately.

We may use safety systems, content filters, and output blocking, but we do not guarantee that all problematic content will be prevented.

6. Your Content

6.1 Content You Submit

Text, choices, chat messages, save data, character chat data, feedback, and other content that you enter, upload, save, or generate in AITANIA are referred to as "Your Content."

You represent and warrant that:

• You have the rights needed to submit Your Content.
• Your Content does not infringe intellectual property, privacy, publicity, reputation, confidentiality, or other rights of any third party.
• Your Content does not violate applicable law or these Terms.

6.2 Limited License You Grant Us

To operate AITANIA, you grant us a non-exclusive, worldwide license, sublicensable only as needed to service providers supporting the Service, to store, process, transmit, reproduce, adapt for technical formatting, and use Your Content to:

• Generate AI responses.
• Provide adventures, character chats, saves, account progress, and synchronization.
• Maintain relationship memory, pinned facts, recent portal memories, and story continuity.
• Provide support, troubleshooting, safety review, abuse investigations, and legal compliance.
• Improve service stability, safety, and product experience where permitted by law.

This license does not transfer ownership of Your Content to us.

6.3 Feedback

If you provide ideas, suggestions, bug reports, or feedback, you allow us to use that feedback without restriction or compensation, provided we do not claim ownership of your underlying personal content.

7. Aether and Virtual Items

Aether is an in-service virtual unit used to access or continue certain gameplay features. Aether has no cash value, is not legal tender, is not a stored-value account, and cannot be sold, transferred, exchanged, withdrawn, or redeemed for money or anything outside the Service.

Current gameplay may include daily Aether, permanent Aether, and Aether usage costs. The app may display the current balance, source, refresh timing, cost, and related limits. We may adjust Aether grants, costs, refresh rules, balancing, availability, or utility for product, operational, safety, anti-abuse, platform, or legal reasons.

Unless the app states otherwise:

• Daily Aether refreshes on a recurring schedule and does not accumulate indefinitely.
• Permanent Aether is tied to the account that receives it and remains available until spent, refunded, revoked, removed for abuse, or lost through account deletion or termination, subject to applicable law and platform rules.
• Aether is consumed only after a successful eligible AI response is returned and passes applicable safety checks. Failed requests, upstream errors, timeouts, and blocked outputs are not intended to consume Aether.

We may correct balances, revoke improperly granted Aether, remove Aether linked to refunded or fraudulent transactions, and take action against abuse or circumvention.

8. AITANIA PASS and Purchases

AITANIA PASS is a paid entitlement that may provide benefits shown in the app, such as higher daily Aether limits, PASS-only or early-access characters, and other Service features.

Paid digital content, PASS access, and Aether packs in the mobile apps are offered through Apple App Store, Google Play, or other platform-supported purchase systems where available. Prices, taxes, product details, access periods, renewal terms if any, and refund options are shown at the point of purchase or by the relevant platform.

By purchasing a digital item or PASS entitlement, you authorize the applicable platform or payment provider to charge the price shown to you. PASS access and other digital benefits follow the terms shown in the app and on the relevant platform.

Important purchase terms:

• Deleting the app or your AITANIA account may remove access to account-linked benefits.
• Platform purchases, refunds, payment method changes, and any subscription management must be handled through Apple App Store, Google Play, or the applicable platform account.
• Restore purchase features depend on platform records, store verification, and successful account matching.
• Refunds, chargebacks, revocations, expirations, or fraud findings may remove or reduce entitlements, PASS access, Aether, or other digital benefits.
• Sandbox or test purchase flows are for development and testing and do not create real paid entitlements unless explicitly stated in a production purchase flow.

All purchases are subject to applicable mandatory consumer rights and the rules of the platform through which the purchase was made.

9. Prohibited Conduct

You may not use AITANIA to engage in unlawful, infringing, harmful, abusive, fraudulent, or disruptive conduct, including:

• Submitting, requesting, generating, or inducing unlawful content.
• Infringing intellectual property, privacy, publicity, reputation, confidentiality, or other rights of others.
• Requesting or generating explicit sexual content, sexual content involving minors, sexual exploitation, grooming, hate, harassment, threats, self-harm encouragement, graphic violence, illegal drug activity, terrorism, violent extremism, or other harmful content.
• Using the Service for medical, psychological, legal, financial, tax, employment, housing, credit, insurance, law enforcement, or other high-risk decisions.
• Attempting to bypass, probe, defeat, or train against safety systems, moderation rules, rate limits, purchase verification, entitlement checks, account protections, or technical restrictions.
• Using bots, scripts, crawlers, scrapers, automated clients, load tests, credential stuffing, reverse engineering, prompt extraction, model extraction, data mining, or similar methods without our written permission.
• Attacking, disrupting, overloading, damaging, or interfering with the Service or its infrastructure.
• Uploading malware, harmful code, or content designed to compromise systems or users.
• Cheating, exploiting bugs, fabricating purchases, manipulating balances, abusing guest accounts, or creating bulk abusive accounts.
• Impersonating another person or misrepresenting your identity or affiliation.
• Selling, transferring, sublicensing, commercially exploiting, or redistributing the Service or access to the Service.

10. Safety and Enforcement

To maintain safety and compliance, we may, where permitted by law:

• Refuse to process certain inputs.
• Block or filter certain AI outputs.
• Remove, restrict, or decline to sync content.
• Limit, suspend, or terminate features, accounts, saves, purchases, Aether, or entitlements.
• Apply rate limits, locks, verification checks, or anti-abuse controls.
• Investigate suspected violations.
• Report suspected unlawful content or conduct to relevant authorities or platforms where appropriate.

Whether and how we take action depends on the severity of the risk, available evidence, legal obligations, platform requirements, and operational judgment.

11. Saves, Progress, and Account Deletion

AITANIA supports local and cloud saves and may sync account progress, story progress, tutorial state, and character chat state. You understand that saves or progress may be lost, changed, or become incompatible due to device failure, user error, local storage clearing, account deletion, network issues, app updates, backend changes, third-party service disruptions, or events outside our reasonable control.

You may request account deletion in the app or through our public account deletion page. Account deletion generally makes the account unrecoverable, removes access to cloud saves and account-linked records, and may cause loss of Aether, PASS-linked in-app access, progress, character chat history, and other account-linked benefits, subject to applicable law and platform rules.

Account deletion may remove account-linked PASS access, Aether, and other digital benefits, subject to applicable law and platform rules. Platform purchases, refunds, and any subscription management remain handled through Apple App Store, Google Play, or the applicable purchase platform.

We may retain limited records after deletion where required or permitted for security, fraud prevention, billing, tax, audit, dispute handling, backup integrity, legal compliance, or enforcement.

12. Privacy and Data Processing

Your use of AITANIA is also governed by the AITANIA Privacy Policy. Please read it carefully to understand how we collect, use, store, and disclose information.

13. Third-Party Services

AITANIA may rely on third-party services, including AI providers, hosting providers, database providers, app stores, analytics and attribution providers, open-source components, platform SDKs, and community services such as Discord.

We do not control third-party services and do not guarantee their availability, accuracy, security, or continued support. Your use of third-party services may be governed by their own terms, privacy policies, and platform rules.

Apple and Google are not responsible for the Service, except to the extent required by their applicable platform terms. Apple and Google's subsidiaries may be third-party beneficiaries of these Terms for the mobile apps where required by platform rules.

14. Intellectual Property

Except for rights that belong to you or third parties under applicable law, all rights in AITANIA and the Service, including the app, code, visual design, characters, story materials, game systems, system prompts, graphics, logos, trademarks, text, audio-visual assets, and related materials, belong to us or our licensors.

You may not copy, adapt, distribute, sell, rent, lease, sublicense, reverse engineer, decompile, scrape, extract, frame, or create derivative works from the Service except as expressly permitted by law or by us in writing.

You may not remove, obscure, or alter proprietary notices.

15. DMCA and Intellectual Property Complaints

If you believe content in the Service infringes your copyright or other intellectual property rights, contact legal@mindzen.sg with sufficient information to identify the work, the allegedly infringing material, your contact information, and a statement that you have a good faith belief the disputed use is not authorized.

We may remove or restrict access to allegedly infringing material and may terminate repeat infringers where appropriate.

16. Service Changes and Availability

We may modify, suspend, discontinue, throttle, or limit all or part of the Service at any time for product, business, safety, legal, platform, infrastructure, anti-abuse, or operational reasons. We do not guarantee that the Service, AI providers, stores, purchases, saves, or online features will always be available, uninterrupted, secure, or error-free.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, AITANIA is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not guarantee that:

• The Service will meet your expectations.
• The Service will be uninterrupted, secure, timely, or error-free.
• AI output will be accurate, safe, appropriate, or useful.
• Saves, progress, Aether, entitlements, or purchases will always be available or recoverable.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

18. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost data, lost progress, lost goodwill, account compromise, purchase disruption, AI output, third-party service issues, security incidents, or inability to use the Service.

Where liability cannot be excluded by law, our liability is limited to the minimum extent permitted by applicable law. Mandatory rights under the laws of your location remain unaffected.

19. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Mindzen AI Studio from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, Your Content, your violation of these Terms, your violation of law, or your infringement of third-party rights.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws rules. If the consumer protection laws of your place of residence provide mandatory rights that cannot be waived, those rights remain unaffected.

To the extent permitted by applicable law, disputes arising out of or relating to these Terms or the Service may be resolved through binding individual arbitration. You and we each waive any right to participate in class actions, class arbitrations, representative actions, or similar proceedings, except where such waiver is prohibited by law.

If a dispute cannot lawfully be arbitrated or applicable law requires court access, the state or federal courts located in Delaware, United States will have exclusive jurisdiction, subject to any mandatory local consumer rights that cannot be waived.

21. Changes to These Terms

We may update these Terms from time to time to reflect product changes, legal requirements, regulatory expectations, or operational needs. Updated Terms become effective when posted or otherwise communicated to you through a reasonable method. Your continued use of the Service after the effective date means you accept the updated Terms.
